Important information about the participation conditions for our exciting competitions with the chance to win great prizes.
Generally
Data Quest AG, hereinafter referred to as DQ Solutions, regularly organizes competitions on its own website or via the social media channels it uses (e.g., Facebook, LinkedIn, Instagram, YouTube, or TikTok) and is responsible for their execution. Therefore, all questions and comments about the competition should be directed to DQ Solutions. DQ Solutions cannot guarantee the proper functioning of the websites on which the competition is held. DQ Solutions is liable, to the extent legally possible, only for damages caused intentionally or through gross negligence by DQ Solutions or its agents. DQ Solutions reserves the right to change, interrupt, or end the competition at any time without explanation, taking into account the interests of the participants, should technical reasons or suspicion of manipulation prevent a proper process, or if the competition is legally prohibited. DQ Solutions is entitled to exclude participants from the competition who attempt to violate the competition rules, provide false information about themselves, or misuse the comment functions, e.g., for spam, insults, or threats. Comments that violate our code of conduct will be deleted.
Terms and conditions of participation
The specific terms of participation will be published on the relevant platform at the start of the competition. Participation in a competition is never linked to the purchase of goods or the paid use of a service, nor does this increase the chances of winning.
The participants agree that DQ Solutions may use the posted or submitted contributions, photos, videos, and other media for marketing purposes.
Eligibility
Eligible to participate on Instagram and Facebook are all individuals residing in Switzerland who have reached the age of 14. Eligible to participate on LinkedIn are all individuals residing in Switzerland who have reached the age of 18.
Unless communicated otherwise in the competition, only one entry per person is allowed with the provision of correct personal data.
Employees of DQ Solutions, as well as their relatives, family members, commissioned agencies, as well as sweepstakes clubs, automated services, and other commercial or professional participants are excluded from participation.
Conduct of the competition
Participation in the competition is only possible during the defined period and according to the rules that underlie the competition. Correspondence regarding the competition is not possible and will only occur with the winner. Legal recourse is excluded.
The winner will be drawn in private or determined in an internal voting process in the case of a photo/video contest, and notified via electronic communication (email, social media) after the competition ends.
The participant agrees to their participation that DQ Solutions may notify the participant via the social media channel. Prizes not claimed within 4 months of notification will be forfeited without compensation.
The prize is defined at the beginning of the competition and cannot be transferred, exchanged, or paid out in cash to third parties. All operating, incidental, and consequential costs arising from the use of the prize are borne by the winner. Prizes over CHF 1000 may be subject to withholding tax and will be reported by us to the Federal Tax Administration. DQ Solutions is entitled to wait with the delivery of the prize until the current proof of residence and possibly other tax-related documents have been received.
Data protection
While the submitted contributions from the competition can be used for marketing purposes, personal data will be treated confidentially. The guidelines for processing personal data according to the Data Protection Act in Switzerland will be adhered to at all times. Jurisdiction
The competitions are exclusively subject to Swiss law, excluding the conflict of laws rules. The exclusive place of jurisdiction is the seat of DQ Solutions.
Final Provisions
Should individual provisions within these terms of participation become ineffective or be ineffective, the effectiveness of the remaining provisions shall remain unaffected.
